HOA Approvals for Fences in Florida

Last reviewed: October 17, 2026

HOA Approvals help a homeowners association check whether a planned fence follows its written rules. In Florida, this review is separate from government permitting. Primo Fence LLC can help prepare the fence layout and documents for your application.

An HOA is a homeowners association. Its governing documents and design guidelines set the rules it may apply. Ask for the current fence application and written standards before choosing a product or layout.

  • Fence material, color, style, and height.
  • Fence and gate locations.
  • Which side of the fence must face outward.
  • Required space between the fence and other parts of the property.

Some HOAs require a fence to start at least 10 feet behind the front face or front corner of the home. Others use a different distance or have no such rule. This is not a statewide rule. Use your HOA’s written guidelines to find the correct starting point and distance.

HOA review and government review are separate

A building permit exemption does not automatically remove an HOA approval requirement. Review Fence Permits and Permit Exemptions to understand the government process. HOA approval also does not replace permission to build within an easement. See Fence in Easement Forms if an easement affects your layout.

Florida Statutes section 720.3035(1)(c) says an HOA or its review committee cannot make an issued government building permit a condition for reviewing an improvement application. You can prepare the HOA review without first receiving that permit. Required government approvals still apply before the work proceeds. Read the current Florida HOA statute.

Prepare a clear application

Include the proposed gate location and design in your HOA application.

Start with Property Boundary Surveys so the proposed fence can be shown on a usable property map. Submit the documents your association requests. A complete package may include:

  • A survey marked with the proposed fence line.
  • Fence height, material, color, and style details.
  • Product sheets or photos showing the design.
  • Gate locations and any required application forms.
  • Neighbor acknowledgments, if your HOA requests them.

Neighbor acknowledgments are not required by every association. Keep copies of what you submit and any written approval. If the layout changes, ask whether the association needs to review it again.

How Primo Fence LLC helps with HOA Approvals

We can review the HOA’s fence application requirements, prepare a proposed layout, gather product and design information, and prepare supporting documents. We can also help respond when the HOA asks for more information.

Send us the current guidelines, application forms, and your survey. The association decides whether to approve the application. Review times and results vary.

Frequently Asked Questions

Do I need HOA approval if my fence does not need a building permit?

You may. The building permit process and HOA review serve different purposes. Check your association’s written rules.

Does every HOA require a 10-foot setback from the front of the home?

No. A setback is a required distance from a stated point or line. The HOA’s written rules determine the distance and where it is measured.

What documents should I submit?

Use your association’s current checklist. A marked survey, fence details, photos, gate locations, and forms are common requests.

Can I replace my existing fence without asking the HOA?

Check first. Replacement work may still need approval, even if the old fence had approval. A change in height, style, color, or location may require a new review.

Can Primo Fence LLC help prepare my application?

Yes. We can help with the layout, product details, supporting documents, and requests for more information.

Choose a fence material

Compare vinyl fencing, aluminum fencing, and wood fencing. Your material, height, and gate design should fit the rules for your property.
